1. Purpose
Welcome to One&OnlyHost. This Acceptable Use Policy (“AUP”) explains our expectations for how you use our Services and outlines your obligations as a customer. By using our Services, you agree to comply with this AUP, which is designed to help maintain a fair and secure network environment. As the Internet, technology, and online practices evolve, so may this AUP. We reserve the right to update or amend it periodically, and the most current version will always be accessible here. Terms not defined in this AUP will have the same meaning as those in our Terms of Service.
2. Policies and Third-Party Terms
This AUP is part of your agreement with One&OnlyHost and applies to all customers using our services. By using our network, you agree to comply with this AUP and all other applicable policies. Additionally, certain services provided through One&OnlyHost may be governed by third-party policies. We encourage you to review and understand any third-party terms relevant to your services.
3. Proper Use of One&OnlyHost Services
We respect intellectual property rights and expect you to do the same. If you believe there has been an infringement of your rights or those of others, please follow the process outlined in our Digital Millennium Copyright Act (DMCA) Policy. You are responsible for adhering to all relevant laws, including those regarding copyrights, trademarks, and patents when using our Services.
4. Prohibited Uses
We strictly prohibit activities that violate laws or disrupt our network. The following examples represent activities that are not allowed when using One&OnlyHost services. This list is not exhaustive, and other forms of abuse may also result in enforcement actions.
- Unsolicited Email (SPAM): Sending bulk emails (over 500 recipients) is not permitted. If your mailing practices result in complaints or affect our network, your service may be suspended. Even if your emails comply with the CAN-SPAM Act, they may still violate our AUP. To report SPAM, contact us at [email protected].
- Prohibited Content: You are responsible for the content transmitted through or hosted on our network. The following types of content and activities are strictly prohibited:
- Hosting topsites, IRC scripts, or bots
- File dump or mirror services
- Promoting or advocating violence, hate crimes, or illegal activities
- Distributing pornography, adult material, or erotic content
- Engaging in lottery or gambling activities
- Participating in pyramid schemes, fraudulent websites, or financial scams
- Broadcasting or streaming copyrighted live events without permission
- Cryptocurrency mining or related activities
- Impersonating others online
- Engaging in doxing or distributing personally identifiable information with malicious intent
- Hosting content promoting human trafficking or illegal drugs
We reserve the right to suspend or terminate accounts that violate these terms.
- Defamation: We operate under New Zealand law and are not obligated to remove content from websites we host unless it has been deemed defamatory by a court of law. We rely on legal orders to guide any such decisions.
- Network Integrity: If your use of our Services affects the stability or security of our network, we reserve the right to take action. This could include suspending your services or throttling your bandwidth to protect the network.
- Monitoring Communications: While we respect your privacy, we may monitor your use of the Services to comply with applicable laws and to improve our network. Any such monitoring will be done in line with our Privacy Policy. Your use of our Services means you understand that your communications may be subject to lawful monitoring.
- Child Exploitation Content: One&OnlyHost enforces a zero-tolerance policy toward child pornography and exploitative content. Any accounts found to host or link to such material will be immediately suspended without prior notice.
5. Usage of Services
- IP Addresses: The IP addresses assigned to you are exclusively for your use with our Services. Any attempt to use other IP addresses or reassign your allocated IP addresses will result in service suspension. IP addresses are not your property and will be reclaimed if your service is terminated.
- Software: Any software provided to you as part of our Services is for your use while you are a customer. It cannot be sublicensed or used in any way that violates our TOS or the licensing agreements associated with the software. We do not provide support for software unless explicitly agreed upon.
6. Notifications of Violations
If you are found in violation of this AUP or any other Policies, our Compliance Team will make reasonable efforts to notify you via email, detailing the issue. We will also take into account any applicable laws and court orders when addressing these violations.
